Terms of service

1. Introduction and acceptance of terms

Welcome to SportEvo. These Terms of Service ("Terms") govern your use of the SportEvo mobile application and related services ("Service" or "Application") provided by SportEvo ("we", "us", or "our").

By registering for or using the Application, you confirm that you have read, understood, and accepted these Terms, as well as the Privacy Policy. If you do not agree with any part of these Terms, you must not use the Application.

2. Definitions

• Club — a sports organisation that uses the Application to manage its activities.
• Club owner — a user with the highest administrative privileges within a single club.
• Coach — a user responsible for managing groups, organising training sessions and matches, and tracking attendance.
• Parent/guardian — a user who represents a minor player in the Application and gives consent to the processing of their data.
• Staff — a club user with limited administrative tasks (e.g., payment administration).
• Player — a person registered as a member of a club. Minor players do not have their own account; they are managed by their parent/guardian.
• Invitation — a single-use invite code or link that allows joining a club in a specific role.

3. Description of the service

SportEvo is a sports club management application that gives clubs and their members the following capabilities:

• Records of players, coaches, parents, and club staff
• Organisation of groups and teams
• Scheduling and administration of events (training sessions, matches)
• Attendance and RSVP tracking
• Records of monthly membership fees and payment status
• Storage and tracking of medical examination expiry dates
• Sending notifications via push and email
• Calendar overview of activities

Important: The Application is a tool for organisation and record-keeping. SportEvo is not a party to the contractual relationship between a club and its members, does not provide sports training services, and does not process financial transactions between members and the club.

4. Eligibility

To use the Application, you must:

• be at least 18 years old, or be a minor with valid parent or guardian consent;
• have a valid email address;
• have a valid invitation from a club (to join an existing club) or a separate agreement with SportEvo (to set up a new club);
• ensure that the data you enter is accurate, complete, and up to date.

Minor players can be registered in the Application only via a parent or guardian's account and with their explicit consent, in accordance with Section 6. Minors and parental consent.

5. Registration, invitations, and roles

Access to the Application is invitation-based. Club owners assign roles to coaches, staff, and parents through the invitation system. Invitations are single-use and tied to the recipient's email address.

Account responsibility

• You are responsible for maintaining the confidentiality of your account credentials (email address, password, and security tokens).
• You are responsible for all activity that occurs from your account.
• You must notify us without delay of any unauthorised access to or use of your account.

Roles and privileges

Each role (club owner, coach, parent, staff) has a defined set of privileges within the Application. The assignment and revocation of roles is the responsibility of the club owner. SportEvo does not decide on the distribution of roles within a club.

6. Minors and parental consent

The Application processes data of minor players only with the explicit consent of a parent or guardian. The consent procedure is described in the Privacy Policy.

• The parent or guardian confirms that they have the legal right to represent the minor and give consent on their behalf.
• The parent or guardian is responsible for ensuring that the minor player's data (including health data) is accurate and up to date.
• Consent can be withdrawn at any time; withdrawing consent results in the removal or anonymisation of the minor's data in accordance with the Privacy Policy and applicable regulations.

7. User obligations

By using the Application you agree to:

• enter only accurate and complete data, including personal data, health information, and membership data;
• update data when it changes (e.g., contact details, medical examination expiry date);
• use the Application in accordance with the law, these Terms, and the Privacy Policy;
• respect the privacy of other users and not share their data outside the Application without their consent;
• handle photos and videos (if you upload any) with appropriate consent of the individuals depicted, or of their parents or guardians where minors are involved.

8. Prohibited conduct

When using the Application, you must not:

• use the Application for any unlawful, fraudulent, or malicious purpose;
• enter false data, impersonate another person, or use someone else's identity;
• upload content that is offensive, threatening, discriminatory, defamatory, pornographic, or that infringes third-party rights;
• attempt to access parts of the system you are not authorised to use, circumvent security measures, or disclose vulnerabilities without responsible reporting;
• use automated tools (bots, crawlers, scripts) to access the Application or extract data, except with our explicit written approval;
• resell, rent, or otherwise commercially exploit access to the Application without our approval;
• disrupt the operation of the Application, including by sending mass requests, overloading servers, or introducing malicious code;
• harvest contact details or other data of other users for purposes unrelated to the operation of the club.

9. User content

You may upload content through the Application, such as profile photos, medical examination documents, and coach certificates ("User Content").

• You retain all rights in the User Content you upload.
• By uploading User Content, you grant us the necessary non-exclusive, royalty-free licence to store, display, transmit, and process that content solely to the extent necessary to provide the Service to the relevant users of your club.
• You represent and warrant that you have all rights and necessary consents to upload such content, including consents from the individuals shown in any photos, particularly where minors are involved.
• We reserve the right to remove content that violates these Terms or applicable law, or that we consider harmful to other users.

10. Membership fees and payments

The Application provides records of monthly player membership fees and their payment status. SportEvo does not process financial transactions between a club and its members, and is not a party to the contractual relationship for membership payments.

• The amount of the membership fee, payment method, and cancellation rules are defined exclusively between the club and its members, outside the Application.
• A "paid" or "unpaid" flag in the Application is an informational record kept by the club and is not a payment receipt issued by SportEvo.
• The fee a club pays to SportEvo for use of the Service is defined by a separate agreement between the club and SportEvo.

11. Third-party services

To deliver the Service we use trusted third-party providers — including providers for infrastructure and database, geocoding and address search, email delivery, push notification delivery, and technical-error monitoring. A detailed overview of provider categories, their roles, and the corresponding legal bases is set out in the Privacy Policy.

We are not responsible for the content, availability, or conduct of third parties. Using their services may be subject to those providers' own additional terms.

12. Intellectual property

The Application, including the "SportEvo" name, logo, software code, design, texts, images, and other content that is not User Content, is the intellectual property of SportEvo or its licensors and is protected by applicable intellectual property laws.

By these Terms we grant you a limited, non-exclusive, non-transferable, and revocable licence to use the Application personally and non-commercially for its intended purpose. Any other use, including reproduction, distribution, modification, reverse engineering, or creation of derivative works, is prohibited without our prior written approval.

13. Availability and changes to the service

We strive to keep the Application continuously available, but do not guarantee uninterrupted, timely, or error-free operation. The Service may be temporarily unavailable due to maintenance, upgrades, technical issues, or events beyond our control.

We reserve the right to modify, restrict, or discontinue individual functionality of the Application at any time. We will notify users of significant changes through the Application or by email.

14. Suspension and termination

We reserve the right to temporarily suspend or permanently terminate your access to the Application without prior notice in case of:

• breach of these Terms or applicable law;
• conduct that endangers the security of the Application or other users;
• abuse, fraud, or malicious activity;
• termination of the agreement between SportEvo and the club to which you belong.

You may stop using the Application at any time and request account deletion in accordance with Section 15. Account deletion.

15. Account deletion

You can delete your account directly from the Application via the account deletion option in settings, or by sending a request to the address listed in Section 22. Contact.

Following a deletion request, your data will be removed or anonymised in accordance with the Privacy Policy, except where we are required by law to retain certain records.

Note that deleting a parent account triggers the removal or anonymisation of data for the minor players that account represents, under the conditions set out in the Privacy Policy.

16. Disclaimer of warranties

The Application is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all express and implied warranties, including warranties of fitness for a particular purpose, freedom from errors, and continuous availability.

We do not warrant the accuracy, completeness, or timeliness of data entered by users (including attendance records, payment statuses, and health data). This data constitutes records of the club and its members.

17. Limitation of liability

To the maximum extent permitted by law, SportEvo, its founders, employees, and contractors shall not be liable for:

• indirect, consequential, incidental, or punitive damages, including loss of profit, loss of data, or loss of business opportunities;
• damages arising from your inability to access the Application, errors in data processing, or the conduct of third parties;
• damages arising from inaccurate or out-of-date data entered by users;
• damages arising in sporting activities organised by the club, since SportEvo does not provide training services and is not the organiser of those activities.

SportEvo's total liability to you, on any basis, is limited to the amount you have, if any, paid to SportEvo for use of the Service in the 12 months before the event giving rise to liability.

The above limitations do not apply to the extent prohibited by applicable law, nor in cases of gross negligence or wilful misconduct.

18. Indemnification

You agree to indemnify and hold harmless SportEvo and its contractors from any claims, damages, losses, and costs (including reasonable legal fees) arising from:

• your breach of these Terms or applicable law;
• content you upload to the Application;
• infringement of third-party rights (including the right to privacy and intellectual property);
• lack of appropriate consent for processing the data of individuals you represent (including minor players).

19. Governing law and dispute resolution

These Terms and the use of the Application are governed by the law of the Republic of Serbia, without regard to conflict-of-laws rules.

We will attempt to resolve any disputes amicably. If amicable resolution is not possible, the courts of competent jurisdiction in Belgrade, Republic of Serbia, shall have jurisdiction, unless applicable consumer-protection legislation provides otherwise.

20. Miscellaneous

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.
• No waiver: Failure to invoke any right under these Terms is not a waiver of that right.
• Assignment: You may not transfer your rights or obligations under these Terms without our prior written approval. We may transfer our rights and obligations to a legal successor or affiliated company.
• Entire agreement: These Terms, together with the Privacy Policy and any separate agreements a club enters into with SportEvo, constitute the entire agreement between the parties regarding use of the Application.

21. Changes to these Terms

We reserve the right to update these Terms from time to time. We will notify you of significant changes through the Application or by email, no later than a reasonable time before the changes take effect. The last-updated date is always shown at the top of this page.

Continued use of the Application after the changes take effect constitutes acceptance of the amended Terms. If you do not agree with the changes, you must stop using the Application and may request account deletion.
